Terms of Service

1. Acceptance
By creating an account or otherwise using Super Chess 16x16 ("the Site"), you agree to be bound by these Terms of Service and by our Privacy Policy, Cookie Policy, and DMCA Policy. If you do not agree, do not use the Site.
2. Eligibility
You must be at least 13 years of age to create an account. If you are between 13 and the age of majority in your jurisdiction, you may use the Site only with the consent of a parent or legal guardian.
3. Your account
You are responsible for maintaining the confidentiality of your password and for all activity under your account. Notify us immediately at admin @ chess16x16.com of any unauthorized use. We may suspend or close any account that violates these Terms.
4. Acceptable use
You agree NOT to:
- Use any chess engine, computer assistance, or third party to determine moves in rated games unless the game is explicitly designated as engine-allowed. Engine assistance in rated play is cheating and is grounds for immediate account closure and rating forfeiture.
- Harass, threaten, or abuse other members in chat, in messages, or on profile pages.
- Post or transmit content that is unlawful, infringing, defamatory, hateful, or sexually explicit.
- Attempt to gain unauthorized access to the Site, to other members' accounts, or to the underlying servers.
- Interfere with the operation of the Site (denial-of-service, automated scraping that degrades performance, etc.).
- Reverse-engineer, decompile, or otherwise attempt to derive the source of the Site's chess engine or its piece-definition format. The data-driven piece-movement engine and the programmable-piece authoring subsystem are the subject of one or more pending U.S. patent applications.
5. Content you post
You retain ownership of original content you post (game annotations, blog comments, forum posts). You grant Roberto Monzon a worldwide, non-exclusive, royalty-free license to host, display, and reproduce that content on the Site for the purpose of operating it. You represent that the content does not infringe anyone else's rights.
Game records (moves and results) are factual data and are not copyrightable; they will be retained on the Site as part of the public game database.
6. Intellectual property
The Site, the Super Chess 16x16 brand, the named pieces (Prince, Princess, Archbishop, Super Knight, Fortress, Programmable Piece), the chess16x16 board layout, the artwork, the source code, and the chess engine are owned by Roberto Monzon and are protected by copyright, trademark, and pending patent rights. You may not copy, modify, distribute, sublicense, or create derivative works of the Site without written permission.
7. Premium and paid features
The Site is currently free to use. If we introduce paid features in the future, the price, billing terms, and refund policy will be disclosed at the point of purchase and become part of these Terms.
8. Termination
You may close your account at any time from your account settings. We may suspend or close any account that, in our sole discretion, violates these Terms or applicable law.
9. Disclaimers
THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL Roberto Monzon, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR LOST GOODWILL. OUR AGGREGATE LIABILITY UNDER THESE TERMS WILL NOT EXCEED USD $50.
11. Governing law and disputes
These Terms are governed by the laws of the United States and of the state in which Roberto Monzon is organised, without regard to conflict-of-laws principles.
12. Changes
We may update these Terms from time to time. The "Effective date" above reflects the most recent change. Continued use of the Site after changes constitutes acceptance.
